Rothley Law is proud to have supported our client David Bolton in a deeply distressing case of financial abuse involving his late grandmother, Joan Green, who was unlawfully deprived of approximately £300,000 and increasingly isolated from her family during the final years of her life.
The case centred on the actions of Pamela Gwinnett, a carer who had developed a position of trust with Ms Green and subsequently persuaded her to appoint her as a Lasting Power of Attorney (LPA). Over time, Ms Green became cut off from her relatives while significant sums of money were misappropriated.
Rothley Law’s Adam Draper and Hollie Richardson led the legal proceedings, working closely with the family to challenge the legitimacy of the LPA and to ensure appropriate safeguarding measures were put in place. Their work resulted in the removal of parental responsibility and the invalidation of Gwinnett’s authority over Ms Green’s affairs.
Gwinnett was ultimately convicted in her absence and thanks to Rothley Law’s work an independent personal representative has been appointed to oversee Ms Green’s estate. A Proceeds of Crime Act (POCA) hearing has been scheduled for January, at which further recovery of assets will be considered.
Speaking on the case, the legal team emphasised the emotional toll financial abuse can have on families, particularly when a vulnerable person is deliberately isolated. “This case underscores the importance of swift legal intervention and proper safeguarding for those who may be unable to protect themselves,” said Adam Draper.
